Post-Judgment Modify & Enforce

Stamford, Connecticut, Post-Judgment Modification Lawyer

Issues relating to child support, child custody, visitation and alimony can arise after divorce. When the parties have a dispute, Connecticut courts may retain jurisdiction over the divorce order to determine whether the terms should be modified. Connecticut courts also have the power to enforce existing orders.

Stamford, Connecticut divorce lawyer Yvette P. Fallon knows how to best handle post-judgment modifications and enforcement. There are times when a divorce order can be modified after the order has been in effect. Examples include:

  • Child support can be increased or decreased if there is a substantial change in either party's income. The law provides a 15 percent guideline to determine whether a change in income is substantial enough to warrant a change in child support.
  • The parenting plan or legal custody can be changed if it is in the best interests of the child to do so. For example, if the child is not doing well at home or in school, or if a parent is not heeding the parenting plan, child custody can be reviewed and changed. The parenting plan can also be changed based on the desires of the child or if the custodial parent wishes to relocate with the child.
  • Alimony can be increased or decreased if there is a substantial change in the financial circumstances of either the payer or the person receiving alimony. Some divorce agreements include a request for nominal alimony in the amount of a dollar per year so that meaningful alimony can be imposed at a later time if financial circumstances warrant.

If a parent is not following orders of the court with regard to child support, visitation, education of children or other matters, we can help you file an enforcement action with the court. Your spouse can be found in contempt of court and punished if he or she does not comply with the order.
